Memorial Diamond
Terms and Conditions.
By signing this purchase order, I hereby agree to the following terms and conditions:
1: This purchase order form evidences my obligation to purchase Memorial Diamonds listed on this form. A deposit of 60% of
the purchases price for Memorial Diamonds, including sales tax in the state of swiss, as reflected on this for is due
and payable at the time this order is accepted by a New Memorial Diamond agent or representative with the remaining 40 %
and applicable taxes will be due and paid in full prior to delivery. This order may not be cancelled and the purchase price
shall not be refunded. (Except as stated on paragraph 3)
2: I acknowledge that in order to form a Memorial Diamonds, it is necessary to utilize carbon collected from a provided lock of
cremation, locks cremation remains. If ordering with cremation remains, I acknowledge and fully understand that in
accordance with my wishes, the carbon will be collected by extracting the carbon from the cremated remains after the
cremation is complete. The cremation remains necessary for your Memorial Diamonds creation are processed as appropriate
for disposition and suitable for inurnment within a sealed and identified cremation remains container. I further understand
and agree that any remains placed in the care of RosenFranz (the company) will not be returned. I
hereby authorize the company to use carbon collected from cremation remains of the deceased for this purpose. I
hereby represent and authorize the company that I am authorized to grant such authority without the consent of any other
person or persons. In the case of cremation samples from more than one person all parties have agreed in writing or have
signed the form below granting full consent.
3: I acknowledge and understand that the formation of a Memorial Diamond is almost always successful, but if for any reason
the process is unsuccessful the full price including taxes will be fully refunded and the company assumes no liability to me
or any third party relating or arising from this purchase order for damages, directly, indirectly or otherwise.
4: If for any reason the actual created Memorial Diamonds is smaller than specified on the order form the final cost will be
reduced incrementally and the company will be held harmless and will not be consider a breech of contract. If the actual
diamond is larger no additional cost will be incurred. Any cremation remains not used in the creation process will
not be returned unless specified in writing at the receipt of this purchase order.
5: The Company expressly warrants that your Memorial Diamonds will be identified as a diamond and will be accompanied by a
grading report by a certified and trained gemologist. Due to the nature of the creation process I fully accept and
understand that the company cannot guarantee or warrantee the clarity of each diamond and that inclusions and
impurities are naturally inherent in Natural, as well as cultured diamonds. All other assurances and warranties, including
implied warranties of marketability and suitability for a particular purpose, are expressly excluded. I also agree to
indemnify the company, its agents, representatives, or suppliers, and hold harmless from and against any loss, cost,
damages, and liability and attorney fees incurred by the creation process.
6: This purchase order shall be governed by the laws of the Swiss, without regard to the principal of
conflicting laws.
7: This purchase order can not be amended, changed or modified without the written consent of the company and myself.
